Awareness, Dementia and Cognitive Impairment
A diagnosis of dementia, Alzheimer’s disease or another cognitive condition creates significant concerns, but a diagnosis alone is not the only fact considered during an appointment.
The notary must communicate directly with the signer and determine whether the signer appears to understand what is being signed and is participating willingly.
